Two people who are not citizens of the United States were arrested and charged on Thursday with unlawfully voting in federal elections, the United States Attorney’s Office for the Southern District of Alabama has announced.
Staciann Pollion Davis and Silvia Delgado Phelps appeared before a United States Magistrate Judge in Mobile following their arrests on federal charges of voting as an alien.
According to the criminal complaints, Jamaican national Staciann Pollion Davis, aged 42 and a lawful permanent resident, is accused of voting in the November 2024 general election in Clarke County, Alabama, despite not being a United States citizen.
Peruvian national Silvia Delgado Phelps, aged 78 and also a lawful permanent resident, is accused of voting in multiple elections in Baldwin County, Alabama, despite not being a United States citizen.
United States Attorney Sean P. Costello said federal elections belong to American citizens. He said that when individuals who are not citizens cast ballots or falsely claim citizenship, they violate federal law, undermine the integrity of the electoral process and erode public confidence in the fairness of elections. He added that the charges send a clear message that the law will be enforced, offenders will be held accountable, and the voting process will be safeguarded for the citizens it is meant to serve.
FBI Mobile Special Agent in Charge Christopher R. Flowers said the integrity of elections is fundamental to public trust in the democratic process. He said the FBI is committed to investigating allegations of crimes relating to elections, following the evidence wherever it leads, and working with law enforcement partners to ensure that those who violate federal law are held accountable.
If convicted, Davis and Phelps each face up to one year in prison. A federal judge will determine any sentence after considering the United States Sentencing Guidelines and other statutory factors.
The Federal Bureau of Investigation investigated the case with assistance from the Alabama Secretary of State’s Office. Assistant United States Attorney John Hutchins is prosecuting the case on behalf of the United States.
A federal charging document is merely an allegation, and both defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
